Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Homiee website, platform and related services (together, the "Services") provided by The Trustee for Homiee Unit Trust (ABN 54 905 045 630) ("Homiee", "we", "us" or "our"). By creating an account, subscribing, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Services. If you use the Services on behalf of an agency or organisation, you represent that you are authorised to bind that organisation to these Terms. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us promptly of any unauthorised use.

2. Subscriptions, billing and payment

  • The Services are offered on a subscription basis. Fees, billing cycle (monthly or annual) and the number of seats are set out at the point of purchase or in your plan.
  • Payments are processed securely by our payment provider, Stripe. By subscribing, you authorise us and Stripe to charge your nominated payment method for the applicable fees, including recurring charges.
  • Unless cancelled, subscriptions renew automatically at the end of each billing cycle at the then-current rate, and your payment method is charged on each renewal date.
  • Fees are stated in Australian dollars and, where applicable, are inclusive or exclusive of GST as indicated at checkout.
  • We may change our fees from time to time. We will give reasonable notice of price changes, which take effect from your next billing cycle.
  • You are responsible for keeping your payment and billing details current. Failure to pay may result in suspension or termination of your access.

3. Cancellations and refunds

You may cancel your subscription at any time from your account settings or by contacting us. Cancellation stops future renewals; your access continues until the end of the current paid period. Refunds are handled in accordance with our Refund Policy, which forms part of these Terms.

4. Acceptable use

You agree not to:

  • Use the Services for any unlawful, misleading, or fraudulent purpose, or in breach of any applicable law, including privacy, spam and real estate regulations;
  • Access, scrape, copy or resell data or content from the Services except as expressly permitted;
  • Attempt to gain unauthorised access to, interfere with, or disrupt the Services or their security;
  • Reverse engineer, decompile or attempt to derive the source code of the Services, except to the extent permitted by law;
  • Share your account credentials, or use seats beyond the number you have licensed; or
  • Upload malicious code or use the Services in a way that could damage, disable or impair them.

5. Your data and content

You retain ownership of the information and content you submit to the Services ("Your Content"). You grant us a non-exclusive, worldwide licence to host, process and use Your Content solely to provide, secure and improve the Services and as described in our Privacy Policy. You are responsible for ensuring you have the right to submit Your Content and that it does not infringe the rights of others.

6. Market data and insights

The Services provide property information, competitor activity, market data, insights and recommendations, some of which is sourced from third-party providers and public records. This information is provided for general guidance only, may not be complete, current or accurate, and is not professional, legal, financial or investment advice. You are responsible for independently verifying information and for your own business decisions and compliance obligations. We do not guarantee any particular result or outcome from using the Services.

7. Intellectual property

The Services, including all software, design, text, graphics and trademarks (excluding Your Content), are owned by or licensed to Homiee and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your internal business purposes in accordance with these Terms. All rights not expressly granted are reserved.

8. Third-party services

The Services may integrate with or rely on third-party services (such as Stripe for payments and third-party data providers). We are not responsible for the availability, accuracy or conduct of those third parties, and your use of them may be subject to their own terms.

9. Availability and changes to the Services

We aim to keep the Services available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features from time to time, and may perform maintenance that temporarily affects availability. We will use reasonable efforts to limit disruption.

10. Disclaimers and Australian Consumer Law

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability for a failure to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the Services or paying the cost of resupply.

11. Limitation of liability

To the maximum extent permitted by law, Homiee will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with the Services. To the extent our liability can be limited, our total aggregate liability arising out of or relating to the Services is limited to the amount you paid us for the Services in the 12 months preceding the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold Homiee harmless from claims, liabilities, damages and reasonable costs arising from your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party, except to the extent caused by our own negligence or wilful misconduct.

13. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or where necessary to protect the Services or other users. On termination, your right to use the Services ends. Sections that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability and indemnities) will continue to apply.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and Homiee submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where changes are material, take reasonable steps to notify you. Your continued use of the Services after an update means you accept the revised Terms.
